ATO Update: Compassionate Release of Super (CRS) Processing Times

ATO Update: Compassionate Release of Super (CRS) Processing Times

Current ATO Approval Speed Status as of 1 April 2026

As we navigate the evolving landscape of Compassionate Release of Superannuation (CRS), we want to ensure our partner clinics and their patients have the most up-to-date information regarding the Australian Taxation Office (ATO) timelines.

The ATO has reached a significant milestone by successfully clearing the high-volume backlog experienced between October and January. We are now in a “stabilisation phase” as the department works to return to its standard Service Level Agreement (SLA).

Key Processing Insights

Based on our daily monitoring of assessment turnarounds, here is what you and your patients can expect:

  • Current Average: Over the last month, assessment timeframes have averaged approximately 22 business days.

  • Signs of Improvement: We are seeing positive momentum, with several recent applications being finalised within 13–14 business days.

  • The Goal: The ATO remains focused on consistently meeting its standard 10–14 day SLA.

Because the backlog has been addressed, applications are now moving through the system in a much more consistent and predictable queue.

How SuperCare is Working for You

While the ATO works through its stabilisation phase, SuperCare is taking proactive steps to minimize “Time to Treatment” for your patients:

1. Direct Advocacy We maintain high-level contact with the ATO’s CRS Department Executive Team. This allows us to lobby for faster turnarounds and immediately resolve any “stalls” in individual applications.

2. Expert Aftercare The ATO approval is only the first half of the journey. Once granted, our team takes over to liaise directly with the patient’s superannuation fund. By managing the secondary phase of documentation with urgency, we aim to shave critical days off the final release process.

Managing Expectations

We recommend that clinics continue to use the 20-business-day window as a baseline for patient scheduling to avoid disappointment, while remaining optimistic about the shorter 13-14 day turnarounds we are beginning to see.

Our Clinic Liaison Team is available to provide specific status updates on any of your pending cases. We appreciate your continued partnership as we work together to ensure your patients receive the care they need without unnecessary delay.

Note to Staff: Please ensure all patient quotes and medical reports are current (less than 6 months old for quotes and 30 days for invoices) to prevent further administrative delays at the ATO level.

Rebuilding Your Super After Compassionate Release

Rebuilding Your Super After Compassionate Release

Rebuilding Your Super After Compassionate Release - Educational Guide

General information on how superannuation contributions work

Accessing your super early on compassionate grounds provides vital funding for necessary medical treatments. Once your treatment is complete, you may wish to discuss strategies for rebuilding your retirement savings with a licensed financial adviser. Depending on your individual circumstances, age, and working status, there are several general methods people use to add to their superannuation. Below is general, educational information to help you understand these options.

Common Reasons for Making Additional Contributions to Super

– To help maintain long-term retirement savings goals.

– To help offset the impact of an early withdrawal.

– Depending on your tax bracket, some contributions may offer tax efficiencies. (Note: These outcomes depend entirely on your personal financial situation and may not be appropriate for everyone).

How to Add Back to Your Super

1. Personal Contributions

Individuals can make voluntary payments to their super fund from their after-tax income. Depending on your eligibility, you may be able to claim a tax deduction for these contributions, which generally means they are taxed at a concessional rate of 15% within the fund.

2. Regular Contributions

Some individuals choose to arrange regular, ongoing contributions through their employer’s payroll system or via direct debit, which allows super balances to grow gradually over time.

3. Salary Sacrifice

A salary sacrifice arrangement involves an agreement with an employer to redirect a portion of pre-tax salary into superannuation. For some individuals, this strategy may reduce their taxable income, but it is highly dependent on individual tax brackets and employer policies.

4. Contribution Caps

It is important to be aware that the ATO sets limits on how much you can contribute to super each year at concessional tax rates (the current general cap is $30,000 per year, including employer guarantee contributions). Depending on your super balance, you may also have access to ‘carry-forward’ rules for unused cap space from previous years.

Important Notes

• Contributions must be made to a complying super fund
• You must notify your fund if you intend to claim a tax deduction
• Contributions count in the year they’re received by your fund
• Seek independent financial advice before making decisions

Here are some common questions about how the calculator works and what the results mean

Early Super Access & Tax FAQ

How is early release of superannuation taxed?

When you access your super early, your payment is split into a taxable component (usually employer contributions and earnings) and a tax‑free component (your personal after‑tax contributions). Your fund will calculate these amounts, withhold tax on the taxable portion, and send it directly to the ATO.

Why does my super fund withhold 22% tax?

Most super funds apply a standard 22% withholding rate on the taxable portion of your withdrawal if you’re under 60. This is sent to the ATO as a pre‑payment of tax. At tax time, the ATO reconciles your actual liability based on your marginal tax rate, if it’s lower than 22%, you’ll receive a refund of the difference.

Will early super access affect my tax return or benefits?

Yes. The taxable portion of your withdrawal is included in your assessable income for the year. This may temporarily affect means‑tested benefits such as Family Tax Benefit or the Medicare Levy surcharge. Your Super Fund will issue a payment summary (or prefill it in myGov) so you can report it correctly in your return.
