What is Compassionate Release Of Superannuation?

Let’s unpack this important legislation

Legislation/Act: Compassionate Release of Superannuation is a provision under the Superannuation Industry (Supervision) Act 1993. It was established by the Australian Government and is now administered by the Australian Taxation Office (ATO).

Purpose: Allows early access to superannuation funds under specific compassionate circumstances, such as medical treatment, medical transport and palliative care for terminal illness.

Tax: Compassionate release of super (often referred to as Early Release of Super) is considered taxable income and clients are thoroughly informed about the tax implications, both over the phone and through our automated email information prior to starting an application with us. It is important to make note of these implications when they are discussed and get further tax advice.

Dependents: It is possible to use superannuation funds to pay for some medical procedures for family members – so long as the family member is eligible pursuant to the Superannuation Industry (Supervision) Act 1993. For further information about the eligibility of your family member(s) as well as the types of medical services available to eligible family member(s), please contact us.

Criteria: When applying for compassionate release of super (CRS) for medical treatment, the law states the treatment must be necessary to treat:
